Peninsula Studios Trading as CNC-Cut
Please carefully check your quote, invoice, or drawing. By making any payment, you accept the exact details listed on it. All goods remain the property of CNC-Cut until paid for in full.
Deposits
A 50% deposit is needed to start work, or full payment if the total is under $200.00. Stocked items must be paid for in full. Lead times kick off from the date we receive your payment.
Tolerances
CNC machining is precise, but here are our standard tolerances:
Linear machining accuracy: within ±0.5mm.
Depth work (e.g., pockets, rebates): within ±1.5mm due to material variances.
Most orders will be closer, but please account for these potential variances.
Design and Setup
The design fee we quote is an estimate based on the files you provide. Extra fees might apply if your files aren’t suitable for production. We’ll always let you know about any needed changes and their costs before we proceed. It’s your job to ensure initial files are accurate and ready for production to avoid additional charges.
Project Scope Changes and Variations
If you request changes to the project scope or design after initial approval or during production, these must be submitted in writing. Any such changes may result in additional costs and delays to lead times. We’ll provide a revised quote and timeline, which must be approved by you before proceeding with the changes.
Customer Responsibility for Nested Sheet Layouts
If you provide nested sheet layouts, you take full responsibility for any manufacturing issues linked to part layout, dimensions, and quantities. You must ensure these layouts are accurate and suitable for manufacturing. Any delays, defects, or extra costs resulting from errors in your provided layouts are your responsibility.
Customer-Supplied Materials
While we aim for the highest quality in our manufacturing, CNC-Cut does not accept responsibility for defects in customer-supplied materials or for damage to parts that happens during manufacturing when using such materials.
This includes, but isn’t limited to, issues from:
Inherent material flaws: Think internal voids, inconsistent density, warping, or pre-existing damage that might not be obvious at first glance.
Material suitability: If the material you supply isn’t right for the specific CNC machining process, even with our best efforts, problems can crop up.
Unforeseen reactions: Materials can react unpredictably during cutting, even with precise machinery.
We recommend you provide materials of known quality and suitability for CNC machining to reduce potential issues. While our team uses professional care and expertise, the final product’s integrity when using customer-supplied materials ultimately depends on the material’s quality and characteristics.
For the best results and to mitigate these risks, we strongly recommend that CNC-Cut supply the material for your project from our trusted suppliers.
Scrap Material and Offcuts
Unless explicitly agreed otherwise in writing, all offcuts and scrap material generated during the manufacturing process become the property of CNC-Cut. If you wish to retain any specific offcuts, this must be requested and agreed upon prior to the commencement of work, and may incur additional handling or shipping charges.
Storage of Completed Orders
Once your order is complete, we’ll notify you. Completed orders can be stored free of charge for up to 7 calendar days from the date of notification. After this period, a storage fee of $20 per day will apply. If an order remains uncollected for more than 30 calendar days, CNC-Cut reserves the right to dispose of, or sell, the items to recover storage costs and any outstanding balances, without further notice.
Terms of Trade
Invoices under $10,000 must be paid in full before order pickup or delivery.
For invoices over $10,000, 80% is due before installation, with the final 20% payable within 7 days of installation.
If installation isn’t included, full payment is required before pickup or delivery.
Quotes are valid for 1 month from the issue date; freight costs are subject to change.
CNC-Cut isn’t responsible for faults or errors in customer-provided materials. This includes digital files, drawings, design specs, verbal or written descriptions, or raw materials.
By accepting this quote/invoice, you agree to all our Terms of Trade.
Product Return Policy
Custom orders are non-refundable once a deposit is paid. You can get exchanges and refunds for faulty goods, but not for faults we told you about or that were obvious when you bought them.
Our goods come with guarantees that can’t be excluded under Australian Consumer Law. You’re entitled to a replacement or refund for major failures and compensation for any reasonably foreseeable loss or damage. Repairs or replacements are available for goods that don’t meet acceptable quality standards, provided the failure isn’t major.
Cancellation of Orders
Any of these actions count as an official sales order and instruction to proceed under our quotation and terms:
Payment of any amounts due related to a CNC-Cut quotation, order, or invoice.
Receipt of any intent to proceed related to a CNC-Cut quotation, order, or invoice (physical, faxed, emailed, or digitally transferred).
For custom orders, if you decide not to go ahead after any of the above, you must send written instructions to cnccutmelbourne@gmail.com, and you need to receive confirmation of cancellation. You’ll be liable for costs incurred in processing, designing, and manufacturing the goods up to the point of cancellation.
Confidentiality and Intellectual Property
CNC-Cut respects the confidentiality of your designs and won’t share any provided materials, files, or specifications with third parties without your explicit consent. All intellectual property rights in your provided designs remain with you. CNC-Cut will only use these designs to fulfil your order.
Limitation of Liability
CNC-Cut won’t be liable for any indirect, incidental, or consequential damages arising from our goods or services, including things like lost profits, business interruption, or loss of data, even if we’ve been told such damages are possible. Our total liability for any claims arising from the provision of goods or services won’t exceed the amount you paid us for that specific order.
Insurance
While CNC-Cut maintains appropriate business insurance, it is your responsibility to insure any customer-supplied materials while they are on our premises. We recommend you arrange adequate insurance cover for your materials and finished goods.
Force Majeure
Neither party will be liable for any failure or delay in performing its obligations under these terms if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, strikes, labour disputes, power outages, significant material shortages, or government actions (a “Force Majeure Event”). If a Force Majeure Event occurs, the affected party’s obligations will be suspended for the duration of the event.
Dispute Resolution
In the event of a dispute arising from these terms or any order, both parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached informally within 30 days, either party may refer the dispute to a mutually agreed mediator for non-binding mediation before pursuing any legal action. The costs of mediation will be shared equally between the parties.
